Abstract. For the past two decades, I have been developing an integrative Christian marriage theory, based in part on a grounding concept of natural law and an overarching theory of covenant. The natural law part of this theory starts with an account of the natural facts, conditions, interests, needs, and qualities of human life, interaction, and generation—what I call the “premoral” goods or realities of life. It then identifies the natural inclinations of humans to form enduring and exclusive monogamous marriages (...) and to preserve these units as the central site for intimacy, procreation, and nurture of children. In this paper, I first summarize this natural law theory of marriage and then compare it to the formulations of other modern Christian thinkers. I also defend this theory against various modern critics of natural law—in part by reinterpreting some traditional natural law teachings that in my view have been misunderstood, in part by looking at the interesting convergences between the insights into sex, marriage, and family life offered by contemporary Christian theological ethicists and by evolutionary biologists and biological anthropologists. The article proposes a framework for the analysis of identity as produced in linguistic interaction, based on the following principles: identity is the product rather than the source of linguistic and other semiotic practices and therefore is a social and cultural rather than primarily internal psychological phenomenon; identities encompass macro-level demographic categories, temporary and interactionally specific stances and participant roles, and local, ethnographically emergent cultural positions; identities may be linguistically indexed through labels, implicatures, stances, styles, or linguistic structures and systems; (...) identities are relationally constructed through several, often overlapping, aspects of the relationship between self and other, including similarity/difference, genuineness/artifice and authority/ delegitimacy; and identity may be in part intentional, in part habitual and less than fully conscious, in part an outcome of interactional negotiation, in part a construct of others’ perceptions and representations, and in part an outcome of larger ideological processes and structures. The principles are illustrated through examination of a variety of linguistic interactions. (shrink)

This investigation was designed to evaluate a new dream content measure, the Casto Spirituality Scoring System. Therefore, our research question was: "Can the spiritual content of dream reports be identified and measured?" We randomly selected 20 male and 20 female dream reports obtained in dream seminars in each of six countries. We added 20 dream reports from one U.S. female and one U.S. male undergoing "spiritual development" programs. Of the 280 dream reports in our collection, 59 contained spiritual content, according (...) to our definition of "spiritual" as one's focus on, and/or reverence, openness, and connectedness to something of significance believed to be beyond one's full understanding and/or individual existence. The research question was answered affirmatively in so far as the Casto Spirituality Scoring System yielded high reliability when the scores of two judges, working independently, were compared. These initial results are promising but further research needs to be done before the usefulness of this system can be fully demonstrated. Key words: dreams, spirituality, consciousness, survey. This Article shows how three modern English thinkers — Hobbes, Locke and Bentham — construe the law as an intersection of secular eternity on the one one hand and transience in modernity on the other, allowing for immovability and movement at the same time, combining stability with change. It details how these theorists, who undoubtedly have earned themselves places of honor in the canon of modern political thought, tried to solve the problem of self-grounding in three different and yet paradigmatically (...) modern ways, each of them intertwining law and time in a different fashion, and each of them connecting both law and temporality to happiness. Thus this Article shows not only that these three British thinkers claim in one way or another that while natural desires may provide pleasure, only the law can bring happiness, but also emphasizes that, in their view, the transformation of the former into the latter entails a transformation of temporal consciousness. Thereby this Article foregrounds two elements that are crucial to an understanding of how seventeenth and eighteenth century British thinkers envisaged the transformation of pleasure into happiness by means of the law: first, the notion that the law creates or reinforces duration in social life, and second, the idea that the law can harness the immediacy of desires by assuring the legal protection of enduring pleasures, which lead to happiness. Corporeality of human beings should be taken seriously and be included in their self-understanding as the ‘nature we are ourselves’. Such an ecophenomenological account has important normative implications. Firstly, I argue that the instrumental value of nature can be particularly well justified based on an ecophenomenological approach. Secondly, sentience is inseparable from corporeality. Therefore, insofar as it is a concern of the ecophenomenological approach to take corporeality and its implications seriously, sentient beings deserve direct moral consideration. Thirdly, it can strengthen (...) the so-far underestimated category of eudaimonic values of nature, which can be best developed through an ecophenomenological reconstruction. Taken together, ecophenomenology is vital for environmental ethics and helps us to leave behind its widespread ‘centrism’. Ecophenomenology should therefore, both methodically and philosophically, be included in the discussion of environmental ethical problems. (shrink)

Drawing on sources such as home furnishing manuals, hygiene and household guidebooks, as well as literary texts, this article examines how the nineteenth-century domestic interior can be regarded as a functional environment regulated by textiles. In the debate about the correct usage of furnishing textiles in line with contemporary aesthetic and sanitary standards, women were held responsible for regulating these textile environments. While on the one hand this led to a supposedly natural and mechanical conflation of women and domestic space (...) which has often been interpreted as restrictive and encapsulating, my aim is to identify a specific feminine agency that has its origin in the home but is not limited to it. By tracing the negotiations of this gendered textile expertise in different fields of knowledge and forms of representation, this article reevaluates the relationship between textiles, domesticity and femininity in the nineteenth century. Drawing on our global database of 582 bilateral labor migration agreements, we investigate the extent to which these governing instruments connect and align with relevant international normative frameworks, in particular the extent to which they represent gains, gaps or gaffs in terms of gender equality and the human and labor rights protection of women migrants. As functional magnetic resonance imaging becomes more precise and the data more extensive, neuroscientists like Kent Kiehl are raising the possibility that such research might someday, together with existing clinical assessment tools, increase our ability to predict the likelihood that a given convict will commit another crime after getting out of prison. Such an advance would provoke challenging questions about our notions of liberty and personal autonomy, with potentially chilling ramifications.

Damit sind zugleich geschlechtliche Zuschreibungen verbunden, die die Frau als Verantwortliche für die Regulierung dieser textilen Umgebungen ausmachen. Während es so einerseits zu einer naturalisierenden und mechanisierenden Überblendung von Frau und Wohnraum kommt, ist mit der Verwissenschaftlichung und Technisierung des Wohnens andererseits eine weiblich konnotierte Expertise verbunden, die nicht allein auf den Innenraum des (...) In this article, we critically scrutinize the principle of proportionality when used in the context of security and government surveillance. We argue that McMahan’s distinction from just warfare between narrow proportionality and wide proportionality can generally apply to the context of surveillance. We argue that narrow proportionality applies more or less directly to cases in which the surveilled is liable and that the wide proportionality principle applies to cases characterized by ‘collateral intrusion’. We argue, however, that a more demanding criterion (...) than the lesser-evil justification that wide proportionality frequently entails is necessary in cases characterized by intentional intrusion upon non-liable individuals. The distinction between foreseeing and intending intrusion into the lives of individuals who are not liable has not previously been specifically addressed in discussions concerning surveillance ethics. This specification is thus increasingly important due to the general growing tendency for adherence to the precautionary principle and policies aimed at anticipating criminal acts before they are committed. Preventive surveillance of non-liable actors is considered an important instrument for obtaining this aim and thus calls for moral scrutiny in terms of permissibility and proportionality. We suggest the concept ‘wide proportionality +’ which applies to cases of intentional intrusion of non-liable individuals. (shrink)

What distinguishes deception from manipulation? Cohen (Australasian Journal of Philosophy, 96, 483 and 2018) proposes a new answer and explores its ethical implications. Appealing to new cases of “non‐deceptive manipulation” that involve intentionally causing a false belief, he offers a new definition of deception in terms of communication that rules out these counterexamples to the traditional definition. And, he leverages this definition in support of the claim that deception “carries heavier moral weight” than manipulation. In this paper, I argue that (...) these cases of “non‐deceptive manipulation” are even more prevalent than Cohen suggests—especially in the digital world. Thus, if his moral claim were correct, a lot of what is happening on the internet these days would constitute moral improvement over old‐fashioned deception. Fortunately, we are not forced to accept this counterintuitive conclusion. Cohen's definition must be rejected because it incorrectly rules out clear instances of deception. In this paper, I defend a definition of deception in terms of evidence that does correctly distinguish between deception and non‐deceptive manipulation. Moreover, it does not support Cohen's claim that deception is morally worse than other forms of manipulation. (shrink)

Employment is critical for refugees’ positive integration into a receiving country. Enabling employment requires cross-sector collaborations, that is, employers collaborating with different stakeholders such as refugees, local employees, other employers, unofficial/official supporters, and authorities. A vital element of cross-sector collaborations is trust, yet the complexity of cross-sector collaborations may challenge the formation and maintenance of trust. Following a theory elaboration approach, this qualitative study with 37 employers and 27 support workers in Germany explores how employers’ experiences in cross-sector collaborations on (...) refugees’ labor market integration affect their trust in other stakeholders in this cross-sector space. Specifically, we explored employers’ perceptions of trust breaches, and how these perceptions affect their further engagement in cross-sector collaborations on refugee integration. Based on our findings, we propose a process model that describes how unmet collaboration expectations and negative assessments of collaborators’ attitudes and behaviors lead to perceived trust breaches which, in turn, lead to employers’ hesitancy to hire refugees and/or to engage in cross-sector collaborations. In doing so, we extend existing theory on trust within organizations to the cross-sector context of refugee integration, uncovering context-specific meanings to trustworthiness dimensions and illustrating how breaches of different trustworthiness dimensions can interact. Moreover, we show how social policies, resources, and trustors’ perceived vulnerability in collaborations shape their risk perceptions. This study highlights the central role of trust for refugee integration and illustrates how missing goals and process clarity endanger sustainable collaborations. (shrink)

Increasingly, clinical research is evaluated on the quality of its statistical analysis. Traditionally, statistical analyses in clinical research have been carried out from a ‘frequentist’ perspective. The presence of an alternative paradigm – the Bayesian paradigm – has been relatively unknown in clinical research until recently. There is currently a growing interest in the use of Bayesian statistics in health care research. This is due both to a growing realization of the limitations of frequentist methods and to the ability of (...) Bayesian methods explicitly to incorporate prior expert knowledge and belief into the analyses. This is in contrast to frequentist methods, where prior experience and beliefs tend to be incorporated into the analyses in an ad hoc fashion. This paper outlines the frequentist and Bayesian paradigms. Acute myocardial infarction mortality data are then analysed from both a Bayesian and a frequentist perspective. In some analyses, the two methods are seen to produce comparable results; in others, they produce different results. It is noted that in this example, there are clinically relevant questions that are more easily addressed from a Bayesian perspective. Finally, areas in clinical research where Bayesian ideas are increasingly common are highlighted. (shrink)
